South Sydney Rabbitohs junior Toby Sullivan has avoided conviction after recording himself having sexual intercourse with a woman without her permission.

Sullivan, 21, was sentenced on Tuesday in Waverley Local Court after pleading guilty to intentionally recording an intimate image without consent.

Court documents state the offence occurred on December 16, 2023, when the talented Rabbitohs prospect was on a night out with mates at the Coogee Pavilion Hotel in Sydney’s east.

CCTV footage showed the young footy star with a 34-year-old woman on the hotel’s dance floor.

The couple later went to an address in Bondi where they engaged in consensual sex in the living room.

The pair soon moved on to the bedroom, where Sullivan recorded himself and the woman on his phone while she was facing away from him.

Court documents noted that the woman grabbed his phone and deleted the recording when she realised what was happening.

‘It’s just for the boys,’ explained Sullivan, before trying to excuse his behaviour by adding that he was ‘just a kid’.

Sullivan left the property shortly afterwards and the victim reported the incident to police the next day. 

Sullivan was charged in March but initially denied he had done anything wrong, even telling police he wasn’t at the Coogee Pavilion Hotel on the night in question. 

Police later recovered the deleted files from Sullivan’s phone along with a selfie he took while inside the woman’s residence.

On Tuesday, Magistrate Michael Barko wondered why the young footy star couldn’t ‘enjoy the sunset’ without having to take a photo.

‘Can’t you people do anything without a mobile telephone?’ he said.

‘Can’t you enjoy a sunset, outside or even sexual intercourse?’

Mr Barko later added: ‘Some would argue the defendant was even lucky to be there, much less share it with his mates.’

Mr Barko imposed an 18-month conditional release order on Sullivan.
